Grievance Process

Definitions 

The contract uses the terms “work days” and “calendar days” when describing deadlines for the grievance process. Those terms are defined as follows:

Work Days: A normal work day of the unit members in the same category as the grievant

Calendar Days: The literal days of the calendar excluding any day the District Office would normally be open but for a declared holiday (Neither the contract nor PCC specify when the District Office would “normally be open,” but it is most likely M-F)

Timeline

  • Within 30 WORK DAYS of Incident: initial filing must occur within 30 work days of when the grievant knew, or reasonably could be expected to have known of incident in question. Must be on an official grievance form and submitted to the grievant’s immediate supervisor with a copy to VP of Instruction and PCCFA.
  • 5 WORK DAYS After: Last day for a meeting between grievant, immediate supervisor and a PCCFA representative. (Referred to as a Level One meeting) VP of Instruction may also attend.
  • 7 CALENDAR DAYS After: Last day for the district to communicate its written decision to the grievant and the PCCFA.
  • 7 CALENDAR DAYS After: Last day to submit a written request to the VP of Instruction and/or designee to move the grievance to the Level Two stage.
  • **Note: If VP attended the initial meeting, this step can be skipped and the 14 Calendar Day time frame for Level Three applies.
  • 7 CALENDAR DAYS After: Last for a meeting between grievant, VP of Instruction and/or designee, and a representative of PCCFA. (Referred to as a Level Two meeting) This can be extended by a day for each grievance the VP has to meet on prior to the grievant’s as the VP only has to meet on one each day per the contract.
  • 7 CALENDAR DAYS After: Last day for the district to communicate its written decision to the grievant and the PCCFA.
  • 14 CALENDAR DAYS After: Last day to submit grievance to superintendent-president or designee For Level Three stage.
  • 14 CALENDAR DAYS After: Last day for a meeting between grievant, superintendent- president and/or designee and a PCCFA representative. (Referred to as a Level Three meeting) This can be extended by a day for each grievance the superintendent-president has to meet on prior to the grievant’s as the superintendent-president only has to meet on one each day per the contract.
  • 7 CALENDAR DAYS After: Last day for the district to communicate its written decision to the grievant and the PCCFA.
  • 10 CALENDAR DAYS After: Last day to submit a written notice that grievance may be submitted to arbitration IF a written decision was submitted. If no written decision was submitted, then deadline is 14 CALENDAR DAYS from meeting with superintendent- president. Must be submitted by the PCCFA to the superintendent-president.
  • 14 CALENDAR DAYS After: Last day for PCCFA to file a demand for arbitration with the American Arbitration Association.
