PACCD-PCCFA Contractual Agreements: New MOUs

Since adoption of the 2013-2016 Collective Bargaining Agreement, the Faculty Association and District have reached additional agreements on several issues of importance to members. These are fully described in eight separate Memorandum of Understanding documents signed by the FA president. The highlights from these MOU agreements are summarized here. 

Class Sizes: The normal closing number (NCN) for Social Sciences classes is reduced from 45 to 40 effective in Spring 2016. A stipend will be paid to instructors with non-large group instruction classes larger than 40 based on the first census.  If all Social Sciences classes are not lowered to 40 by Fall 2017, the stipend will increase. For English 1A and 1B the NCN will be 28, effective Spring 2016. A stipend was paid during Fall 2015 for instructors with larger classes.

Assessment responsibilities: In an MOU signed in October, it is agreed that all faculty members are expected to use the results of the assessment or learning outcomes to inform and improve teaching and learning. Full-time faculty members are expected to participate in the development and assessment of student learning outcomes and report the results … according to established procedures. Full-time faculty members are expected to participate in the development and submission of Annual Assessment reports and to integrate results in the Program Review. Adjunct faculty are not responsible for any assessment work unless they receive an explicit written request from their respective Dean. They will be paid $100 per course to administer the SLO assessment.

Maximum health insurance contribution:  This July MOU sets a maximum amount on the District’s contribution to employee health insurance costs. The maximum effective October 2015 is set at $1,803 per month. However, for those covered under the Kaiser HMO plan during the 2014-15 year, the maximum is set at $2049 per month. In addition, coverage under the Anthem Blue Cross plan is modified to include a mail order prescription drug plan and emergency room copays of $100.

Adjunct health insurance: Under the ACA, the District will offer a health insurance plan for eligible adjunct faculty working 30 to 39 hours per week or 130 hours per semester. For the 2015-16 year, the District will pay half the premium for the employee only in an Anthem health plan, with the employee responsible for the remainder.

Salary Schedule:  A January, 2016 MOU made formal previously agreed revisions to the salary schedule effective July 1, 2015.

Winter holidays: Also in January, the District agreed to add three holidays over the winter break to eliminate the necessity for faculty members on 12-month contracts to use vacation days when the college is closed.

Jury duty leave: On January 29, the District and FA agreed that adjunct faculty will be granted the same rights and responsibilities as full-time faculty regarding subpoenas and jury duty. The MOU is intended to ensure that adjunct faculty members suffer no monetary loss because of service on a jury. Jury duty leave will be granted to adjunct faculty when they are absent due to a mandatory court appearance, except when he or she is a litigant. In cases in which the faculty member is a litigant, absences may be charged to sick leave (personal necessity leave) if the faculty member so chooses.

Cash in lieu: For the 2014-15 year, this MOU sets the amount faculty members will receive if they elect cash in lieu of health insurance benefits. A total of $6,000 will be paid for the year, with monthly payments varying depending on whether the faculty member is on a 10-month, 11-month or 12-month contract.
